Terms of Service

These terms are an agreement between you and the Five Element Heroes Team ("we", "us") about the mobile game Five Element Heroes (the "game"). By playing the game you accept them. If you do not accept them, please do not play.

1. Who can play

You must be at least 13 years old, and old enough under the law of your country to accept these terms, or have the permission of a parent or guardian.

2. Your account

• You can play as a guest or sign in with Google. A guest account lives on your device: if you lose the device or remove the game before signing in with Google, the progress may be lost.
• Keep your device and Google account secure. You are responsible for what happens in your account.
• Each server (world) of the game has its own character for your account.

3. Virtual items and purchases

• Diamonds, heroes, items and everything else in the game are a limited, personal licence to use them in the game. They have no real-world money value, cannot be exchanged for money and cannot be sold or transferred outside the game.
• Purchases are made through Google Play, under Google Play's terms. Refunds are handled by Google Play according to its refund policy.
• If a purchase is refunded or charged back, we may remove what it gave you; if those items were already used, we may lock the account until the matter is settled. A locked account can file an appeal in the game.
• Some features give random rewards, such as summons. What you can receive is shown in the game before you summon.

4. Fair play and conduct

You agree not to:

• cheat, use bots, modified clients, speed tools or exploits, or interfere with the game's servers or other players;
• buy, sell or trade accounts or items for real money, or use unauthorised payment methods;
• post insulting, hateful, sexual, threatening or illegal content, spam or other people's personal data in chat or names;
• impersonate us or other players.

If you break these rules we may warn you, mute you in chat, remove items gained unfairly, or suspend or close your account.

5. The game can change

We keep improving the game: we may add, change or remove features, balance heroes and items, run events, and have maintenance. We may stop offering the game; if we do, we will announce it in the game in advance.

6. Our responsibility

The game is provided as it is. We do our best to keep it running and fair, but we cannot promise it will always be available or free of errors. Nothing in these terms limits rights you have under the consumer law of your country that cannot be limited by contract.

7. Privacy

How we handle your personal data is described in the Privacy Policy.

8. Changes to these terms

We may update these terms. We will post the new version here with a new date, and tell you in the game when the change is important. If you keep playing after a change, you accept the new terms.
